GreenTree/Ditech/Walter investment management groupI had never had a problem with my mortgage company except the day I went to pay my mortgage. My lender was unable to accept my payment because it was sold to GreenTree? I had not received any notification, and had to use the handwritten phone number that I was handed to call my new mortgage company GreenTree? This is the day my mortgage nightmare began. 1st every method of payment except check required a fee, including bill pay! The customer service reps were rude and constantly transferred my calls without ever stating they were transferring me. Each new rep I had to start all over again, only to be transferred again. An escrow account was started without my knowledge ! I had been paying higher payments to pay down my princible, now that payment was pkaced in escrow, so I was prevented from paying down the princible, which I had been doing with my prior lender. My tax department allows payments to be paid twice per year, or you can pay it in full at the 12 month payment which is what I had been doing. GreenTree snatched up the six month payment. At the end of the year I discovered that GreenTree paid the incorrect tax payment and a tax lien was placed on my property! I paid the corrected tax to my tax department to remove the lien. My TRW now shows I had a tax lien! I had been speaking to GreenTree for months to have the escrow removed, they finally agreed if I sent them $1500.00, I did this and the escrow was removed. The rep sent me written confirmation of the escrow being removed. My payments were returned to normal and my stress and anxiety were relieved. A few months later my mortgage statement arrived, and Ditech was the new name and I again had an escrow account, and my mortgage increased by $6000.00! I am again spending my life on the phone with rude, unhelpful people, who constantly transfer me, again without stating I am being transferred. Knowing that my escrow was removed I paid my 2015 taxes and homeowners insurance, but again I am being forced to pay this amount to Ditech? I was told yesterday that Ditechs tax department did not approve of the way my tax department printed out their receipts so they are unable to apply my credits. However they did credit one tax payment after months of mailing in the documents from my tax department. If they could understand one tax receipt why not all of them? However if they did apply all my credits then they would not be able to foreclose on my home. It is to Ditechs benefit to delay processing my credits in order to make it appear that my account is passed due. Months ago out of frustration, I wrote the check Ditech wanted, however there representative stated "do not mail the payment, on numerous phone calls. all business calls are recorded. I have been requesting a full accounting of my account since I was with Greentree, and still do not have this. I pay my mortgage each month. A Ditech rep stated that Ditech is holding over $3000.00 above what I have paid in mortgage payments, and outside of my escrow account but these funds are not applied , to my account? I have money that are in suspense, and unapplied funds that are in separate accounts. Ditech is also refusing to honor the agreement that I had with Greentree. When Ditech acquired GreenTree (after the lawsuit for unlawful acts against their customers) they also did not honor previous agreements and arrangements. My taxes are again at risk, my home is at risk, my health is at risk all because of this companies unwillingness to have competent customer service personal, and questionable business practices. When a client call is transferred in my business we inform are clients that we are transferring them, we then inform the rep. Of the clients demographics. Clients do not have time to waste repeating information. I must remove my mortgage from Ditech, unless they are willing to act ethically, and professionally. I advise all Ditech consumers to record all calls, keep your documents in order, and consult with an attorney. When the proof is in our hands it is hard for any company to dispute truth, and hard facts.My regret is that I did not get an attorney 2 years ago, Others did and a class action was won against GreenTree, and restitution will be paid back to the mistreated customers. I will meet with Mr. Dixon president of Ditech to discuss my issues. I will give them a chance to correct this, if they are not interested then I will be forced to file an official complaint with the FTC and all other necessary agencies as well as take other necessary action as. I do believe in allowing a right to be wronged before reporting to a governing body.

I unfortunately feel your pain my friend. My original lender was wonderful.

However, my mortgage was sold to Greentree without my knowledge and it's been a complete nightmare for the last 17 years !!! Always saying we are behind when we aren't, charging extra fees for this and that, rude and inept employees, etc. Complete nightmare ! We are just about at the point of letting them have the house and renting something elsewhere.

It's too much to deal with. And shame on their executives for allowing their company to be operated this way and their customers to be treated this way. I'll guarantee that half of the employees are barely educated. Three times they have asked us to send a post dated check.

We complied all three times. What did they do ? Deposited the check immediately and over drew my bank account. They are shameful and shameless.

My advice to anyone...make sure Ditech / Greentree is NOT the lender when you are offered a mortgage. If they are...RUN !!!

Do not sign anything with these people. You WILL regret it !

Green Tree Services

Years ago when I was layed off I tried to get a modification with then but they never helped me out. Sent in information time after time to get nothing They had the nerve to try to treat me like a dog so they took me to court to foreclose on my house there for I had to file chapter 13 to keep my house.

They are crocks!! now they change there name to ditech. I think that Green tree should be held responsible for what they have done to me and others who lost there homes.

Hope they have to go back and payback or help pay off the people that they failed to help.

DiTech/GreenTree is committing the exact same thing that ended their offices in a class action lawsuit. Presently, they have slapped Force Placed Insurance on my home unknown to me.

In addition, their ledger sheets show that my insurance was paid for from Escrow and horrible communication breakdown with their offices. I was never informed or even notified of this forced placed insurance and worse yet, my insurance was paid. 3 days after finding this information out from a DiTech collector, a storm hit my area causing hail/wind damage to my home.

IT is horrible the way that I have been treated by this company and I am due to pay off my mortgage in a few months. I have read the horror stories posted by customers all over and I firmly agree it is time the Government and President Trump be made aware and do something to stop this from happening to people.

Well I can see where ours is going. Where you are. We are fighting the escrow, insurance that they had increased "greatly" was totally fraud. I called my agent and she got THAT fixed. Property

taxes went down, so they have yet to explain why payments that have been increased 3x in last 6 months almost by $100. They claimed escrow - a lie.

And their most famous fraud: payments that are improperly posted to "unapplied funds", then Greentree-Ditech HOLDS those funds until they are past due. Account is actually current, but sitting in unapplied funds and we - the mortgage hostages do not know this. That is, until the Certified Letter of Notice of Default comes. Three months we have played this game - with my demanding the payment be posted correctly and do NOT charge me a late fee. The latest is that the account is current (after they were informed AGAIN

to post "unapplied funds" to our mortgage payment). However, between November and December the payments increased AGAIN - by $4. Okay, that makes two payments where I am a total of $8 owed technically to make it current. They state it is $29 I owe. I tell them to do the damn math and tell why the discrepancy! The CSR (a robot) repeatedly states $29. No doubt anything above the $8 are fees and this practice of ripping off for fees is so obvious and old. And I now know for a fact that when *I* send an electronic payment from my bank, it is posted the next day - in "unapplied funds." Like they refuse to honor it. Yet when you make the

payment on the phone (fee charged, of course) the payment is posted correctly. I refuse to pay the fee. As for the first bogus NOD demanding then $80 in late fees for funds in "unapplied", my husband, once in collections, got the representative to admit on the phone "it is all about generating revenue"! That is their job. Generating as much revenue as possible at any cost. That is their job. Period. Just debt collectors at their most ruthless.

There is no 'servicing' of any mortgage going on here. Like I said above, this game of applying Mtg. payments in the wrong account is so old. *** - I busted BOA on that scheme in 2009-****! Have the old spreadsheets to prove it. And HOW did that turn out for them??

The account is current and correctly posted except for their $29 of which they will not tell me what that entails above and beyond the $8 I do owe because of another payment increase unknown to us. "You would not begin foreclosure for $8 would you?", I asked, now

livid. A Certified NOD for an incorrect amount of $29? Really? Yet we have it. And this game is repeated over and over. And they hound you and threaten mercilessly..

And his reply: "Legally they can begin foreclosure." To which I told him "you go on ahead and do what you have to do, and I'll go ahead and contact my State's AG, HUD, Social Media, and my state and federal representatives." End of conversation.

As a PS: Last night, they called at 8:53 p.m. Before she could get our address verified I told her the same I told the rude robot man last week this call constitutes continuous and COMPOUNDING harassment.

Unfortunately, like the gentleman above we cannot afford an attorney to help us sort this mess out. Medical bills have us financially devastated. We cannot sell the house - it is underwater. Any shortfall you know these wolves will hound you with a deficiency judgement.

I just want to get the word out that though the name may have changed (which they routinely do after the lose their class action lawsuits), the practices are the same and they seem to be escalating in ruthlessness.

BOA->Countrywide->Greentree->Ditech...a lepoard does not change its spots.

I have been trying to male bi monthly payments for 3 months. I have filled out the same paperwork 3 times which is no exaggeration.

Everytime I get a letter saying they can't because of several different reasons. The last 2 times is because they said I did not pick a proper due date. Both times I called and after a 15 plus minute wait I was told what was considered a valid due date only to get a later saying I did not.

I am not behind and pay every month but Ditech does not have a qualified staff to due a simple bi monthly payment schedule. I bet if I was behind I would be hearing from them about repossessing my house.

Want to join Class Action lawsuit against Greentree

They would not modify my 2nd mortgage under the HAMP program even though I modified my 1st mortgage with BofA and made unlawful threats to me by stating they would arrest me, seize my property, garnishment of wages, and foreclosure, and used loud and abusive language, mocking my financial struggles, and yelling and cursing at me. They also added insurance to my account and told me they would not allow monthly payments and wanted the entire balance up front. The company also revealed debts to my employer, neighbors, and family members, and encouraged them to tell me to pay the debt or help them pay it.

Owned our house for 20 years made our mouthy payment each.green tree serving took over our loan in 2009. They would take our payment out thd first week of the month out of our bank account but it was not posted to our Loan until 25-30-45 days after they took it out of our bank account.

With a 9.99% interst rate our monthly payment was eat up in late fees and interest changers. After making a conplain to the CFPB green tree sent us a payment history record when we checked it with bank statements at less one payment a year was not posted to our loan. On there records they say the was no payment made but when I checked it with bank statements they pulled the payment out of our bank account but never posted it to the our loan. They changed us each month a $12 speed pay fee as well but it's not on the records.

But it's shown on our bank records. While trying to modifitv the loan green tree sold our loan to us bank. That way they could get away with steeling our home. The new loan holder couldn't be hold responsible for what green tree had done.

They never foreclosed on our home. The new loan holder wanted 67,713. For the house or they would take the home. That's was what the oraignal price of our home in 1997.

And 20 years late and paid 144,00 to green tree. Us bank wanted that price. They attorney for green tree serving laid in court and said that he wasn't green tree attorny he was us bank attorny. But if you look up green tree attorny his name is listed under green tree.

No where Is his name listed under us bank. The people moving my home off my land worked for ditect, they new name for green tree. But still the same company. After the CFPB found green tree guilty for sterling people homes.

They are still able to treat people the same way just under a new name.

They left 4 people homeless after 20 years and make I g payment to them in the sums of 144,000 dollars. And the small county courts are letting them.

Bank of America turned over our home mortgage loan to Green Tree Servicing. During 2013 and 2014 ( possibly longer), we paid down our principal by more than $650 per month.

We sold the property April 15, 2014 and have never received a DETAILED accounting for the excess payments, nor did Green Tree audit our account to verify the accuracy of the principal, interest, insurance and the remaining escrow at the time of closing.

Is there any way to obtain free assistance in getting a complete and valid accounting of our mortgage loan?

In 1999 I applied for a home loan.WHile on workmanship comp.At first after giving 500.$ earnest fee.i did not qualified for loan.Two months later I qualified for two smaller loans.And 340.$310 was for land,$340 was for Mobil home.Then went to closing and signed contract for land and Mobil home.I payed for land and house for 10years.At that time I was informed that contract did not match land and house.Contract was for 3 bedroom 2 bath Mobil home.My home was a 2 bedroom 2 bath.Nothing matched contract.Serial #,size,color,location,contract was for Mobil home in another county,20 miles away.At that time I informed Greentree that the contract did not match.Greentrees replied that it does not matter,pay anyway or they were going to sue me.I replied go ahead.Go ahead and sue me.They did in 43 district court.case #cva10-0001.J.Silver aka Greentree did not show up for court.They reset a new court date.again no show.After two no shows tried to reset another hearing,was denied.They took it to another Judge,I was not informed of new hearing with Judge David Cleveland.he ruled for Greentree A $20,000 judgement and court order to take model home listed on contract this was Oct 14th.Court order to take home was .determined unserverable,by county attorney John Forest.case closed.Feb 2nd !deputy of Parker county.John Woverton served court order to take home.gave me 20days to move out,it was tapped to my front door.nothing on court order was correct.except my name,and it was spelled wrong.March 24Th M and M model home service came and removed home.Distroying every thing around my home with sledge hammers and tractors.They took out 50ft of chain link fence with a chain and a tractor 8By8 utility room with washer and drier with tractor.Distroyed and ran over 5 oak trees for no reason.Removed model home with use of three tools,sledge hammer,cutting torch,and crescent wrench.All while deing watched by Parker County deputy's,by order of a assent ant county attorney Wilson.Forcing two disabled veterans to live in tents and rv's,last five years.

Same old *** different name

Walters Company owns Green Tree Servicing. When GTS was fined by the FTC and was going to have its credit rating reduced, GTS was transferred to Ditech. Now Ditech went out of business during the 08 financial crisis for making bad loans. Ditech another company owned by Walters Company rebranded all the Green Tree Servicing employees as Ditech employees. So whats changed? Nothing! Same *** service. Same *** employees and the same lets screw em over attitude because Walters Company enjoys the profits we make for them.

This company has forced so many people into foreclosure that it makes one wonder. Who can help you? No one can! It takes thousands for complaints for the Govt to do anything and when they do its not for you its for them. For them to look and feel good.

Its really sad that we have a consumer protection bureau that can not do a dam thing for you expect take complaints. That's it! There are so many companies out there who are run-a-muck creating nightmares that our local, state and federal govt can do nothing.

So yes, file for bankruptcy right away and then sue them in court. You will win. Juries hate these kind of companies. Don't fall for the lawyers who take on thousands of clients to represent you in a class action law suit. You don't get ***, and they get millions.

I fell really sorry for those who have and are getting screwed over my the Walters Company and all its minion companies.

I was with Homecomings(North Carolina)ended up with GMAC, thrown over to Greentree, and they became Ditech. In my opinion they are vultures.

The interest is so high, very little of a payment goes to principle.

They have it structured so you can never get it paid off. Frankly, I wish I had never heard of any of them.

I also have had many issues with greentree.

7 payments made in 2015.

Confirmation given by phone and I had them send me a each time.

Then I received a letter from them stating that I am now defaulted on the mortgage. BS PERIOD

I challenged it.

They sent me a letter stating the breakdown of what transactio were made.

Yep, showing that I missed several payments.

BS AGAIN

on the right side of the letter, it states that the paymentswere set aside in a separate area.

I called them I would say, about 20 + times.

In hopes of resolving this.

Each and every call was nothing but lies , deception, and I was informed that the paperwork was incorrect.

WHAT - you sent it to me.

I finally got the repersentive to admit that truth.

He started yelling at me, just the same thing as all of the other calls I made! !!!!!!!!!

The repersentive told me that he would give me the lost 7+thousand dollars and 2-more thousand dollars and give the house back to greentree. WHAT, YOU CAN'T TELL ME THAT! #!

like always, asked for his last name and extention number.

Nope, just like the other people who I called, refused to give me the information.

I was called by the supervisor and she yelling at me and said that nothing like that could have been said.

She said that I am a lying on this and slammed the phone down.

GUESS WHAT HAPPENED NEXT. I RECEIVED A LETTER FROM GREEN TREE LENDERS STATING THAT THEY ARE FORCOLSE ON THE HOUSE. WHAT.

AND IT IS A EXCELLED ONE THAT IS 30 DAYS.

I WAS SHOCKED TO SEE THIS.

ONLY WAY TO STOP THIS CRAZY *** WAS TO FILE A CHARTER 13.

THIS WAS A YEAR AGO THIS FEBRUARY.

EVER SINCE THEN MY ATTORNEY AND I HAVE BEEN SLAMMED WITH NON FOLLOW THRU BY GREEN TREE LENDERS.

ALWAYS CHANGING THE NEW MODIFICATION WE DID IN SEPTEMBER.

GET THIS -!!!!!!

THIS YEAR I RECEIVED YET ANOTHER MODIFICATION IN THE MAIL. MODIFICATION CHARGE AND DIFFERENT FROM THE ONE THAT I SIGNED.

THEY REMOVING THE PAPER WORK THAT MY ATTORNEY. MYSELF AND THE COURT SIGNING.

Beating Them At Their Own Game

I never had a problem paying my mortgage when it was with GMAC - never a lost payment or threat of foreclosure. I received monthly statements by no later than the 15th of each month, wrote the checks and they were posted promptly: Every statement was accurate.

After Bank of America(GMAC) as well as other large financial institutions (Ally, Citibank, et al) sued by Attorneys General from 25 states in 2011, they filed Chapter 11 reorganization and dumped accounts that had either low interest rates, were close to pay off or had a late payments on record.

My mortgage payments were never late but because I had a low interest rate and owed less than $65,000 GMAC sold my acount to Green Tree Servicing LLC a subsidiary of Walter Investments Inc.:

When my mortgage collection was sold to Green Tree from GMAC in 2013, I researched them: It was alarming to discover that they had a reputation for instigating foreclosure by magically 'losing' or misappropriating customer payments then charging late fees when customers balked, so I was determined to make photocopies of every statement, check and Certified Mail tracking number, then send every mortgage payment via Certified Mail.

I also wrote to them asking them to produce a copy of the note of origin and proof of their legal ability to collect payments from me (this is for assurety in the event that a lawsuit may later be filed that I did make correct legal inquiry of the company to collect mortgage payments). They responded with a copy of the original note but declined to produce legal proof of collection claiming "security issues."I printed a log of payments directly onto their monthly statement to show them that I was keeping meticulous records of the dispersal of monies.They sent me threatening letters from the Rapid City office demanding the total payoff which is completely illegal as it violated the terms of the note, so I wrote back requesting a copy of the source from the note supporting their demand for payment - They never replied.

Now, as they have a new caprice: I have been paying extra money to the principal to pay down the loan quicker and wrote a check last month for over $1000 extra to be applied to the principal. When I received this month's statement for the October mortgage, it showed that they did not apply the extra $1000. They processed the standard mortgage and dispersed the principal and interest as a normal payment.I called Green Tree immediately and spoke with a supervisor who said that they could access the check AGAIN and pull $1000 from it. I said, "No, I will take care of it on the next payment." but I asked, "How could they post the wrong amount from a customer check?" The supervisor answered glibly, "Oh it happens all of the time." I said, "No. This is unacceptable."She then said,"Well, I'm not in payment processing."I wanted to scream, "Then what in the *** Are you doing, offering advice?!"I told her that I keep thorough legal records of every payment. She then stated that "This phone call is being recorded." I answered, "Good. I want it to be recorded."I met with my financial adviser of my bank who explained that when you write a personal check the recipient has automatic permission to process it in any manner they wish, however, the fact that Green Tree did not apply $1000 was troubling. Because Green Tree, now DITECH elects to post payments electronically, it causes real problems for the bank to retrieve monies or correct mistakes.

Strategy that will prevent Walter Investments (Green Tree, DITECH or any other subsidiary trying to take your home) from forcing you into foreclosure:For $25 you can place a Stop Payment order on Green Tree and DITECH on your checking account, then pay your mortgage each month with a cashier's check drawn from your bank.They will no longer have access to your routing number and as it is a bank check fdic they are less likely to "lose" the payment.

Keep good records:1. Make photocopies of every document that you send to Green Tree - DITECH.2. Mail payments by Certified Mail - The Post Office owns the PO Box addresses, so YES, You CAN send Certified Mail to a PO Box Address.3. Organize all payments and correspondence in chronological order so that if or when you need an attorney you have solid proof of payments and letters that will help your attorney if you have to go to court.4. If you have a retirement plan that you can borrow from and owe less than $55,000 inquire if you can borrow from your retirement and pay it back without a hefty penalty. 5. Think creatively how best to pay off the loan.

Do not waste your time contacting the State Attorney General's Office - they are the reason your mortgage was sold, AND they represent the government not the individual. Consumer protection is not really designed to help taxpayers its about their 'image' - I know because I worked for them. Bunch of snakes.

Refinance is a bad idea because you are not only rewriting your loan and losing your equity, BUT, you HAVE NO GUARANTEE that your new loan won't be sold back to DITECH! You're better off paying down the principal and then pay off the loan in a do-able lump sum as long as there is no penalty for early payment on your original note.

File a complaint with Consumer Financial Protection Bureau and your attorney general, which probably has a consumer protection division or can refer you to the appropriate agency.

The Dodd-Frank Wall Street Reform and Consumer Protection Act, which created the CFPB, established consumer complaint handling as an integral part of the CFPB’s work. The CFPB began accepting complaints as soon as it opened its doors in July 2011. It currently accepts complaints on many consumer financial products, including credit cards, mortgages, bank accounts and services, private student loans, vehicle and other consumer loans, credit reporting, money transfers, debt collection, and payday loans.

The Bureau expects companies to respond to complaints and to describe the steps they have taken or plan to take to resolve the complaint within 15 days of receipt. The CFPB expects companies to close all but the most complicated complaints within 60 days.

In June 2012, the CFPB launched its Consumer Complaint Database, which is the nation’s largest public collection of consumer financial complaints. When consumers submit a complaint they have the option to share publicly their explanation of what happened. The CFPB and the FTC settled a huge case with them in April 2015. They are supposed to be monitoring greentree and probably Ditech which they were merged into. You can easily find it on the web.

You also might be able to bring a small claims action in your local court, if your state has a small claims court system.

Collect all of the documents and summaries of phone calls and anything else you have to prove your claim. Make copies and keep the original.

I bought my Mobile home new back in may 2000. For $29000.00 and i still owe $22000.00 on it.

It been 17years and they know this is a rip off.
