OK, here's the deal with GreenTree & BoA

OK, folks here's the deal with B of A and Green Tree.

BOA was required by Fed's to dump all their Mortgages, some 500,000 to Green Tree & others...BOA tried dumping this same amount to Fannie Mae and was immediately sued for "dumping defective mortgages" and quickly settled. Then sold the same "defective" mortgages to Green Tree & others. These "defective Mortgages" are mostly forged signatures on notes and mortgages that BOA could not collect on. BOA has submitted forged and altered documents with Courts all around the country. Now Green Tree is trying to do the same thing, with the same forged documents.

Everyone should go to their County recorders office and check on ALL documents, if you had Country Wide home loan or BOA mortgage chances are your loan is NOT valid.

Mortgages transferred by M.E.R.S are NOT VALID. MERS does not own any title to your property. Try finding a phone number for MERS and talk to any live person, there are none. Green Tree is THE most unprofessional company I have ever had to deal with, they lie, they are extremely rude & they steal property every day all over the country. Check with local Laws and if permitted in your state, RECORD EVERY PHONE CALL you have with them, put the date and time and the persons name on the tape, so it has foundation to use as evidence in court, you do not have to inform them you are recording if you live in a "One party state" DONT'T let these people "steal" your home. Make them send you a certified copy or color copy of your "original" note and Mortgage. They must have the the "original" note and mortgage, signed by you in ink, not a copy.

Green Tree acquired these mortgages for pennies on the dollar and will do anything to either steal your home and/or your money, lie, cheat, steal & intimidate to get something they are not entitled to. They know that most of these loans are "un-collectable. DO NOT let them bully you into giving up your home, DO NOT leave your home until the Sheriff or court says you have to. If you leave your home, they can steal it because they assert that you abandoned it. Most of the mortgages Green Tree "acquired" from BOA are bogus and most of them forged. Almost every loan that Country Wide had and BOA acquired from they're purchase of County Wide is fraudulent.

Please do some research and keep them from stealing your home. Contact the FTC or your State Attorney Generals office and FILE A COMPLAINT.

Green Tree is currently submitting FORGED mortgage notes to courts across the country in order to fraudulently foreclose

and steal homes. I had a forensic examination done and my very own signature was forged along with a fake, stamped endorsement added in order to produce an illusion that everything is on the up and up, when IN FACT, it is quite the opposite.

ANyone who is facing foreclosure where Countrywide or Bank of America (fka countrywide as they like to refer to themselves), and now Green Tree are involved. PLEASE check what they are submitting to the courts very carefully. You will most likely find fraudulent, legal instruments that are being doctored and being used as evidence to steal your home. Instead of rolling over and allowing them to take what they have NO RIGHT to take...inform the judge.

Even if you do NOT have the means to hire an attorney or forensic examiner ...if you can see the fraud, then make sure you raise your concerns to the courts. They are committing fraud upon the courts and the evidence should NOT be allowed to be used to foreclose. FORGERY is a FELONY. Racketeering, wire fraud, notary fraud, forgery, etc.

the lists goes on and the rabbit hole is VERY deep.

DO NOT assume they are in the right, because even if you fell behind on your payments...if countrywide or bank of america or green tree are involved, there is a very high chance that they are committing crimes to steal what they have no right to.

The biggest problem everyone faces, is that neither the federal Government nor the State Attorney's offices are the least interested in your problems. 1/2 of the agencies are mere formalities and the other 1/2 are in bed with Green tree in the form of retirement investments and investment funds.

State Governors refer you to the federal Agencies which in turn will forward your complaint to Green Tree. Once Green Tree's legal Department answers to your complaint, the matter is closed. It's all a big gigantic joke. Forget the BBB, they are the biggest joke of all.

I personally wrote over 100 letters with a very valid complaint and was ignored - even by ALL the news media. Green Tree is a MAFIA CARTEL with STREET ENFORCERS doing their DIRTY DEEDS.

BE VERY CAREFUL with your LIVES....EVERY CONVERSATION IS being RECORDED ( and it's legal because they warn you when you call them )... You have been FOREWARNED....

green tree is the most horrible company in existence. I cant believe fannie mae allowed this to happen.....remember the government pays boa and fannie mae any deficiency in the mortgage when they sell it to another bank or servicing company

Insurance Coverage-

Green Tree sent a request to verify insurance for a condo that I own. I immediately responded by fax and included a coy of their letter along with the condo insurance and a copy of an additional policy that I have to include the interior of the condo.

Green Tree responded and stated there was an issue with the name on the policy. I've owned this property for 7 years and since purchasing the property, I've had a name change. In the past, Green Tree has never had an issue. However, this year they sent a letter stating they needed the policy rewritten with my old name or I needed to update my loan information and provide documentation of my name change. I contacted my insurance agent, and did exactly what Green Tree requested, and had the name on my policy changed to match the name on the loan.

I just received two more letters from Green Tree stating the policy that I sent with the correct name was not the insurance policy they were looking for, and they are threatening to purchase insurance at my expense.

I contacted Green Tree to inquire about the initial fax that I sent, because that contained the policy they were looking for. Green Tree claims I either never sent it or I did not put the account number on the fax. I have a confirmation fax with a copy of their letter they sent me along with the insurance policy and account number. I'm not sure what they did with the original fax, but this issue still has not been resolved.

I am beyond frustrated with their incompetency and customer service. I am in the process of filing a Better Business Bureau complaint as well since I feel they are harassing and threatening me with purchasing an additional insurance policy at my expense. I've spent way too much time dealing with their inability to track and maintain records.

don't let them cause it will cause you more problems in the long run. they will charge you interest, higher insurance cost that don't cover much and if you have to file a claim, good luck getting the money back from greentree to do the repair.

I delt with that twice.

I was also forced to take thier insurace company that still don't cover what is owed on the loan. greentree sucks

Don't waste your time with the BBB they have over 850 complaints from customers of Green Tree and they have the company rated with a B. I do not believe in the BBB after see that.

I've been dealing with a similar situation since April!!! First they didn't have my policy, then they needed the proof that I had the policy in place when they took over the loan in March (my policy renews in April), so that was sent to them.

Then they didn't have the master policy from the HOA. That was sent and now I received another letter that I'm going to be getting forced insurance because the HOA policy is expiring on Oct 23 and they haven't rec'd a new one (that's six weeks away)!! Each time I talk to them, it's some other excuse and the insurance premium hops on and off my mortgage statement like crazy!! One month it's there and then it's gone and then back again.

I've owned this condo for ten years and have never spent so much time dealing with a mortgage co.

Reading all of the accurate stories here, we don't need to add our own family's story. Just know that the stories here are similarily duplicated with us too. Writing on behalf of my family I will add instead some insights into who we are dealing with and how to deal with them.

Based on just observing the unprofessional and unstable behavior of the bullying staff at the company, that is oddly called "Green Tree", they unfortunately appear to suffer from alcohol and/or drug abuse, or at least some forms of mental, emotional and spiritual illnesses. Add these weaknesses to an already dominating and narcissitic personality, who are out of touch emotionally with themself and others, and who knows well what others think of them, but doesn't care, we're dealing with a criminal mentality.

Its like dealing with a gang of cowardly thugs. They are attracted to the line of work as a group because its a way for them to get an unhealthy thrill in their otherwise boring, unfullfilling, unhappy lives. They may even be involved in other criminal activities as of yet unseen to the public, so keep this in mind.

Just know that you are not alone in being mugged by this group of bored but destructive people. Keep holding your head up high, maintain your dignity and good mood, KNOW that you are a good person, and be courageous enough to report them to the Better Business Bureau.

Talk to your local sheriff or police department too to learn from them how you are not alone. If you can afford legal assistance, do so. Just remember that the overall personality of the people at "Green Tree" loves a challenge, but they fear being controlled by others. They feel a need to control others instead as a way to use their dominating energy.

Do what you can to minimize contact with them, and when you are in contact with them, be professional and level-headed. To help you act this way, be well-rested and well-fed BEFORE attempting to communicate with the drugged-like or drunk-like staff.

Unheathly interactions with them will be going on for awhile, so conserve your energy. The current personality of a "Green Tree" staffer immaturely enjoys creating and extending conflict - they have the energy and time and are being paid to do this - so consider this relationship to be a long-haul bad relationship, and one that will end badly eventually, like all bad relationships do. Unless you can just walk away and do nothing more with this gang, comfortably brace yourself for more attempted punches to your face from the staff.

Don't expect to ever be treated fairly and rationally by this group. Remind yourself to compare this unhappy relationship to being in one with someone high on cocaine and or drunk on alcohol. There is no way any rational thinking will get through to them. The only way the staff and leadership will be taken away to sober up is with them kicking and screaming, like children having a tantrum. They hate to feel like they've lost a battle and control - eventhough the battle and control is only in their imagination.

YOU have to be the clear-minded adult in this situation instead and take responsiblity for being honorable and healthy eventhough the staff at "Green Tree" is not. So don't lose your temper to the extent that you can't think clearly yourself. Just be at peace in your mind that you are doing the best you can with weak minded & hearted immature humans who need a healthy dose of discipline and an education in emotional intelligence.

Just objectively accept how the "Green Tree" staff and leadership has gone over the deep and dark end of the canyon right now. They are clearly acting dishonorable. Perhaps they don't know any other way to behave in life. So take care of yourself first and foremost. Keep order in your life somehow, no matter how hard "Green Tree" tries to crate chaos and more insecurity in your own.

It's actually best to avoid having anything to do with such negativity, but until then, find ways to enjoy your life and humor and enlightenment. Be compassionate and forgiving for in any way finding yourself in this situation. Find the silver-lining and know that this too shall pass, eventually.

Just be brave enough to report "Green Tree" to the Better Business Bureau, talk to your local police, receive legal advice, continue to bring their destructiveness to the light of day. Keep in mind that the leadership and staff may be involved in drugs and alcohol abuse, and other criminal activites as of yet unknown. And above all else do what you can do maintain a healthy balance in your own life. It's just a house. It's just money. It's just stuff. While healthy and loving human relationships are priceless and above all else are what is the most valuable in our lives.

This company is fake!!!! Don't pay!!!

My mortgage was transferred in Feb, I haven't been able to contact GT since I heard they were taking over. I've registered on their website to pay and manage my account, but no account info is displayed.

It's just a message that says " call customer service" I've tried calling 84 times, no one answers the phone. I have even paid them 2 payments but I have no idea where the money is going or what the *** is going on. So if someone from GT logs on to read these complaints, I hope they read this.

Green Tree is the worst mortgage service company in the USA, they are foreclosing more mortgages than they are servicing. Green Tree Servicing is owned by Walter Investment Management Corp in Florida.

Search the internet for "complaints about Green Tree" more than enough to read, plenty of people for a class action. Stop the terror from Green Tree, file a complaint with your local Senator.

i know how you feel ok i just refianced with greentree for a fixed rate and they did pay my taxes and homeowners insurance as well maybe since a lot of people have been complaining they have gotten a little bit better. Hope everything is ok with you. love, pam

Green Tree is the worse in harrassing people-got 5 calls in two days from them; didn't answer

I, like a lot of people here, got their B of A loan sold this past spring to these jerks. I've owned 3 houses in 15 years and only was late twice during that stretch. This month's (August of 2013) is going out on Monday since I'm short on cash this month. I initially received a harassing phone call on Tuesday the 6th from a collector at Green Tree, whose first words were "do you intend to keep this property?", which of course I said yes. Then he kept on saying 'your late here after the 5th day, can I make arrangements for you to pay?" I told him I would be mailing the payment on the 12th and he responded "I can set up a payment to withdraw on the 15th for you but you will have to pay a servicing fee of $12). At this point, I told him "no" I will mail the payment and he proceeded to say "what, do you want a NSF charge of $34 by doing that?".

I ended the conversation and hung up. Since then, I've counted 5 phone calls from Green Tree in AZ (guess that's where their call center is" and didn't bother to answer one. I just contacted their corporate office in St. Paul, MN and asked to speak to Keith Anderson's, their President, Executive Assistant and was routed by the operator to some supervisor who would only give me his first name and ID number.

I told him to stop harassing me. as no bank I've owned a mortgage with in 15 years called me after a few days of being late, let alone 5 times: not even Bank of America! He told me I can write a letter asking me to send a letter to stop calling me to some PO Box (6172) in Rapid City,SD. I told I was going to send a certified letter and need a physical address and he refused. I then said I was going to send a letter to corporate to Keith Anderson's attention, referencing all these hundred's of posts on the internet on how bad customer service they are.

I am a Collections Rep. You continue to get phone calls because you are not answering.

You are getting the calls because you hung up on the representative that you spoke to. You have to answer the phone and complete the conversation with the representative. We will call back if you hang up on us and it is not harassment. If you bring you loan current and keep it current you would not be called at all!!

This should go without saying. Yf you feel that the rep is being rude, simple ask for a supervisor but do not ignore the calls and by all means, bring your loan current and continue to pay on time.

Green Tree Servicing White Collar Crime

This has got to be the worst company on earth. The representatives harass you even after you have explained your situation of being behind (not even a month). They have increased my monthly payment by more than $300. From what I've read, they have done this to several people.

They make up lies and swear you've said something you didn't. I have begun the act of recording each and every phone call with these fools. There are some Facebook pages dedicated to informing people who have mortgages with this company. One FB page is Green Tree Servicing Sucks and the other page is Victims of Green Tree Servicing. There is a petition to investigate this company too. Not *our* problem!

our family is under financial strain. there are reasons behind that strain and we are looking ahead to fix things BEFORE the strain becomes a disaster.

We decided to contact green tree to apply for a modification on our loan. This was middle of May. I was told to fax over all docs. I did so.

a few days pass I call to make sure they were received. I spoke with Dillan. he went over the mod. process with me I said I understood all of that and that I had already faxed the information over.

He stated taht yes an account had been opened for the Mod but no fax had come through, mmm? ok I will resend. My husband called to make sure fax went through and was told yes they were recieved. a few days pass and in the mail I receive a whole new packet and two letters one says we are reviewing your application and documents we will be in contact with in 30 days.

the next letter says you are about to be disqualified due to not having proof of income and two months bank statements. the two letters dated the same day and the packet dated 8 days before. I called and spoke to Dana who from the moment she picked up the phone had an attitude with me and i had yet to even tell her why i was calling. with a partial explanation she begins to ask me why we are behind in payments?

I said we are Not behind in payments. well then why do you need a modification, because we are at risk of falling behind. she then tells me that although a fax was received only one page came through and there was no way for her to retrieve the missing 14 pages, she was quite an angry woman I have no idea why. I told her I would resend all documents through the mail with ATT.

Dana on it she said Okay you do that. kinda like what ever!that was on June 19th. I called Dana on Monday June 24th to see if she received the packet. before I made that call I said to myself be OVERLY NICE see if you can crack her anger and turn it to peace.

Ha! i don't believe that is possible! I started by asking how she was doing blah blah blah. then asked if she had received the packet.

she said I told you we only received the one page out of the 15 butr i spoke to my manager after we talked last week and he said you do not qualify, although you had neck surgery your choice to have your adult daughter and her family living with you is your choice. I said to her " is there a reason you are coming off so aggressively towards me? IM NOT! im just telling you what my manager said and just because you had neck surgery and have your adult child and her family living with you is why you don't qualify.

I said " uh huh well i understood that the first time you said it. she said well its NOT OUR Problem that you choose to let your children move in you don't have to let them move in! I said can i have your managers name? she said yes its Marty.

and his last name? no we don't disclose that information due to security risk. WTH??? okay, his extension?

she gave me that I said goodbye. called Marty I was given voice mail Marty Wintworth left a nice out going message that he would return my call if I left the information which I did. He didn't call back. I called the next day.

Marty had me on hold for 12 minutes twice coming back on to ask me to continue to hold. third time he asked me call back in two hours, I did. I got his voice mail. I called the next day and every day till today and same thing voice mail.

will now file a complaint with the federal trade committee and see what happens. I would suggest that every 500 plus people who have complained on here do the same thing. this is for sure a site to put voice to our complaints but to complain to the state or fed gov.

It is a bad company. My husband and I have gotten behind.

We want to get caught up and stay that way but they told me that they dont refinance or modify loans , when we asked. Never would give us any paper work to fill out. I have had to defer payments twice which they did do but was probably a mistake because there is no telling just how much they deferred on to the back of our loan. No matter what we pay it is never added to the principal always the ridiculous amount of interest.

They want you to stay behind and keep charging you late fees and whatever.

They want foreclosures and bad debit because they suck you dry and the take you house. Just so they can go to the next person they can suck them dry

most of what ive read from other customers has happened to me, this company should be hung by its balls, with all these problems/complaints how does the bbb let them stay operating and continue to screw us over, if the tables were turned and it was u or i screwing people over like this we'd be locked up in prison, its a shame that the way of the world is all about greed and money and taking advantage of people for profit. its a good thing they dont have a storefront because there would be a long long line of us waiting to take one of these bastards heads off. the old saying was to love thy neighbor, today its *** thy neighbor, what a *** up country america has become and its an embarrassment to be one of its citizens...

You are so right I'm getting a Lawyer because they don't know what *** day it is they are in another world I wood rather deal with someone over seas that I can't understand,In the past 6 months my house payment went from $550 to $1323 for Dec. how does that happen Tried so many times to talk to them and one lady was singing to the computer I ask who are you speaking to she said the computer Really !!!!!

Still never got know where with anyone at that crazy place. So sent them a letter with a certified check and a letter that they said they never received but did cash my check Who is there to help us with this nut case place

I'm being threaten foreclosure when I only 1 month late on a payment. They refused to take my payment on the phone because they want more personal information about me and why I'm late!

These people are relentless when it comes to harassment and unethical practices. They are worst then loan sharks by the Mob.

At least the loan sharks will take a payment. They refused to take my payment after I refused to give them personal information of why, when, what, where, who of my life. None of your business! Just take my late payment.

Then threaten to foreclose on you! When I ask to speak to another manager or supervisor, they refused to give me the information then hung up! Why haven't the anyone sued these people!

Where is the owners or investors! Are they allowing this type of unethical business practices!

Green Tree will not repond to Harp 2 loan request

I have been calling Green Tree for two months trying to apply for a Harp 2 loan. Bank of America sold my loan last November to Green Tree.

I contacted Bank of America and they told me that the could not offer me a Harp Refi as it is only available to their current customers.

I am stuck between a rock and a hard place as I would like to take advantage of the opportunity to have this loan. I am sure that there are many who are in my position.

Who can we contact for help with this matter??? Green Tree is not responding.

green tree is calling me as soon as my load got pushed to them from Citi mortgage.. so no idea why they don't respond..

i just called back at 1-85*-***-**** ..

hit zero (not listed in the voice automaton) got a person agent and had them transfer me to the refi department .. and off we went.

Green Tree is a very deceitful company to deal with. My wife contacted them to do a HARP and was told that what they were offering was better than a HARP.

What they didn't say was that it was only better for them. All of a sudden there was a point to buy down the interest rate and all kinds of other fees totaling over $8000.

We had done 5 other HARP loans with other banks with $0 fees but no one tried to screw us like Green Tree.

I was working through wells fargomfor a HARP loan and greentree has my HELOC. They delayed and delayed and finally said they would not subordinate.

I feel Theybare holding me hostage.

I spent 3-4 months being led to believe i was set once GTS subordinated. It is a crock and am not sure what to do now

Hi All - I too had a countrywide/bofa loan sold off to Green Tree (and yes they may be the worst cust svc company on the planet !). I refi'd with Quicken (minimnal effort, ltv was way upsdide down) and unfortunately I did ask about the loan being resold and was told yes, it would be going back to Green Tree.

I just got the notice of the switch back after making the first payment. So, you can escape them via Quicken..for a little while. I found Quicken's costs very high but financed the costs into the loan and it will pay off in the long term.

Good luck to all of us stuck with Green Tree. I personally feel someone ought to put them out of business.

If you are a Fannie/Freddie loan and are going through a HARP I/II refi with Quicken, you WILL automatically go to Green Tree after closing. Your credit and LTV does not matter.

HINT: Look up "articles of novation" and mention to the agent when discussing a refi.

I also contacted GTS in March when HARP 2.0 was supposed to be in effect. I was told GTS does not lend in Ohio after several months of waiting.

Just this weekend,I got a letter from GTS stating that they are working with Quicken Loans to do HARP loans and to contact Quicken Loans. I cant wait to get my loan away from GTS, worst lender I have ever dealt with.

In the same boat as everyone. I was told by my account rep @ GTS in April2012 that they would have new guide lines for HARP2 soon.

Its now mid Oct he hasn't responded to my emails. I also have contacted other loan brokers and no luck there either. My LTV ratio is 160%. I have good credit- in the 700's.

Current. Never missed a payment. The loan brokers say that FANNIE MAE declined me.

I called FANNIE MAE, they said they don't make a yes or no decision. Looks like lenders r writing their own rules and noone is following HARP gudelines, not even FANNIE MAE!!!!

Terrible to say the least

I was transfer from bad (bank of america) to worse (Green tree servicing) a few months ago and the best I say is this company should be put out of business one way or the other. Rude, disrespectful, careless to name a few. A total nightmare !

Constant harrassment

Constantly getting calls from our rep "Ian the ***" and the first thing he asks..."What are your intentions for the property?" You *** son of a ***, what do you think they are? I say to him, "What is the purpose for the call?" 5 times and asks if I am going to answer. I tell him "What is the purpose of the call? he says, "When you are ready to answer the easy question, call me at 877..." I say, " I am not calling you back, you will call tomorrow and the day after."

"callinoutstupidpeople", you are an ***. Please learn to spell, perhaps a grammar class would aid your tiny mind. Whether or not you're a Green Tree employee is beside the point, though your IP shows that you are within the vicinity of your mother ship, you obviously do not know your own company contract that you so viciously claim is not being followed.

As per Green Tree's contract, people not only have a grace-period (as human error is due to exist), those same people are being harassed by the ineptitude of lessers such as yourself.

You should remember that a contract is only applicable as long as both parties follow the precise rules contained within it. Someone like "Way2slk" still had a grace period, someone like yourself is breaking the contract and Federal Law by threatening and intimidating the people who are still following their contractual obligations.

As far as I can tell, those contracts have become null and void because of people like you. As the Green Tree geniuses have broken the contract (in order to make a piddly profit off the backs of hard working Americans), no customer is beholden to the agreement.

This goes far beyond the bickering point of lawsuits and simple harassment. Your methods defy the U.S. Constitution, Federal Laws, and the local anti-harassment statutes of every State. Ergo, you, your company, and all those individuals who contribute to this ridiculous onslaught of attacks should be deemed an enemy of the United States, charged heavy fines for harming the "life, liberty and happiness" of each citizen that deals with you, and forced to shut your doors; lest you cause more harm to innocent people.

you ever thought if ypu paid your mortgage on time then they wouldnt be calling you to make your pmnt as you agreed to in the mortgage contract you signed when you bought the home! Be smart dont complain when your in the wrong!

GreenTree Loan Processors are Totally Incompetent

In January, 2013 I was notified by GMAC Mortgage that GreenTree Servicing was taking over my mortgage due to GMAC bankruptcy. I made on time payments and have not been late.

In March, 2013 I contacted GreenTree to see if I could do a refi to get a lower rate. I was told by the loan officer that I was "one of the of the fortunate people who Fannie Mae instructed GMAC to sell my mortgage to and I was eliigible for a lower rate." I wa stold that this was a no doc , no credit check refi.and wa swhat they call "streamline" I was emaile ddocs and read these and esignature by me and my wife. I was told that closing could be in April or early May. They then told me they needed more information and closing would be June 5.

They were sent by email from me a notification that I would use my own title company. In between they informed me that I needed a subordination from a lender ona second mortgage. They said they would get that but later informed me that I had to request it. During that time they changed loan processors 3 times.

I was assured by the loan officer and new laon processor that everything was now moving along. They then notified me that closing would be June 5th. When the papers were reviewed I questioned costs and why they did not use my title company. I refused to sign any papers at that time since we could not reach the loan processor or officer.

The following day the loan processor returned my call and apologized that he did not follow up and make sure my title company was used. Since June 5th there have been two other closing dates, July 5 and July 8 both of which were cancelled by GreenTree because they could not get the paperwork to the title compnay and found anothe document that they needed and received. Clsoing is now scheduled for June 10, 2013 IF they get the documents to the title company by Monday July 8. There is now another loan processor involved and no return calls or emails are being sent by the loan officer.

I hope this new person is competent.

I would like to get the names and adresses of all top management from CEO down to send a letter to them and tell them that the people they have working for them are totatly incompetent and should be dismissed.

If GreeTree is any good these people are not doing anything right.

Illegal Foreclosure

Originally my home loan was through GMAC then Select Portfolio Servicing. Both of which I never had issues with.

We have owned this home for 7 years. A year ago Green Tree bought our loan. As I have for the past 7 years, pay my bills through my bank, paying my mortgage every month. Last Saturday I was served with a notice of Trustee Sale on this home from an attorney!

I could not figure out what was going on! I immediately typed up a letter disputing this as an illegal foreclosure and have all of my bank statements reflecting my payments every month! I called the attorney today and explained this is an illegal action and told them I have all of my documentation. They asked me to fax it and I did.

Next I called Green Tree. What a joke! I explained once again the documentation I have and my account is not delinquent! Green Tree then asked if my payments were sent back to me?

No! I did not have any credits nor were any checks mailed to me! The rep then stated that my account shows thousands delinquent! This is impossible!

They have taken my payment every month and my bank records reflect that! The Green Tree rep then tells me she doesn't know what happened to my payments! I faxed her all documentation/payments since they took the loan over! Green Tree has my house scheduled for auction in August while all payments have been made!

This company is stealing homes illegally and I will fight and turn them over to all necessary agencies and go public on my experience! This is not a legitimate company!

I just got off the phone with these *** they are saying they held my last month payment because it was short? So they increased my mortgage by $125 with NO explanation, then hold my payment to make me 30 days late, now threats of foreclosure?

How is this legal? Anyone thinking ofsuing their pprevious lender for selling their mortgage to these ***

you are right they sold my home and told me that it was nothing could do because my name was not on the loan,my pass away in 2011 we have not went threw probate and that would not work with the day before think giving that went to my home threw out my future and sold meta and broke acquits ever one they do this to,turn them in to FCT.GOV

Monday, May 6, 2013Contact: Phil Sisneros 505-222-**** or Lynn Southard 505-222-****(ALBUQUERQUE)---Attorney General Gary King today announced a settlement with Green Tree Servicing, a major lender and servicer of consumer loans, resolving claims that Green Tree abused the probate process to fast-track foreclosures against the estates and families of deceased homeowners in New Mexico. AG King alleges that in at least twenty-five (25) cases in New Mexico, Green Tree became the personal representative of a deceased homeowner’s estate in order to quickly complete a foreclosure against the home of the deceased consumer.

As part of the settlement, Green Tree agreed to never again be appointed as the personal representative of a homeowner’s estate in New Mexico. The AG alleges that Green Tree would file documents in court stating that it was unaware of any heirs with legal priority over Green Tree when, in some cases, Green Tree clearly knew that a surviving spouse or children existed and could be located. The Attorney General’s Complaint asserts that such false statements to the court were misrepresentations in the collection of a debt in violation of the Unfair Practices Act. As a result of the unlawful acts, AG King alleges that Green Tree would complete the foreclosure without giving the lawful heirs an opportunity to save the home or to defend the foreclosure case.

Green Tree would then sell the home and pay itself the proceeds. Green Tree agreed to pay $140,000.00 to the Attorney General to resolve the claims. The funds will be used for consumer protection enforcement and education.

The parties agreed to the settlement terms in a Consent Decree that must be approved by the Court.Green Tree denies that it engaged in unlawful conduct. The claims settled by the proposed Consent Decree are allegations only, and liability was not determined in a trial.

I applied for a HARP 2.0 refinancing on May 14th, and provided all the required documents and a processor by the name of Scot Kershner send a goodfaith estimate for 3.1% for 15 years, Aftere painfull 57 days yester day at last I managerd to get in touch with him and he told hme he is ready to close the loan , hopwever he did not lock the rate and rate now is 4.0 % and he is blaming me for not asking him to lock the rate and this *** claims that he has 16 years of mortgage experience.

After submitting the applications, when ever I called this people they gave a different persons name, Like Kevin Dixon and so many others, but cannot give me an exat status of my loan. Most of the time they did not even have the courtsy to return the calls.

To comply with the process, this greentree forced me to pay off some of the outstanding debts wrth thousands of dollars.

I belive this delay is not accidental, I did some research on the web and found out there are so many out there with similar situations with Green Tree servicing, I am convinced thay this company may have some benifit for not doing the process since they own my mortgage and is more benificial to keep it in the same way.

I am trying to contact othere people in my similar situations and file a class action law suit against this highway robers. Some one have to stop them doing this unethical behavior.

same thing happen to me they did not lock in rate now it is half point up but i have my lawyer looking at because they have it set up like floating loan which they can but the other papers state different i'm on there *** good luck
